Conditional Offer questions
Why have I got a Conditional Offer?
You have a Conditional Offer because you have admitted to driving a vehicle whilst either speeding or running a red light.
Why have I not received a CO?
If the speed that your vehicle was travelling at was classed as an excessive speed you will not receive a CO and the Courts will deal with the offence. Also, if you already have points on your licence and any more points will take you past 12 penalty points or six penalty points if you are a new driver then the offence will be dealt with by the courts.
How long will the points stay on my licence?
Points remain on a licence for three years but cannot be removed until after four years. Your insurance company may want to know about any points in the last five years.
I feel I have a legitimate reason for speeding or running a red light.
The safety camera partnership does not have any power of discretion and can not cancel an offence. If you wish to challenge the offence do not pay the Conditional Offer and the Procurator Fiscal will arrange a court hearing.
I have a non UK Driving Licence, will I still be offered a Conditional Offer?
No, if you have a non UK Driving Licence you will not be given the option of a Conditional Offer. All non UK licence holders, who do not already have a D9 counterpart, will be reported for prosecution and will not be issued with a Conditional Offer of Fixed Penalty.
I want to accept the Conditional Offer, what happens next?
Send both parts of your driving licence (photo card and paper counterpart) with a £60 cheque or postal order to any Scottish Sheriff or Justice of the Peace Court, within 28 days from the date of the Conditional Offer being issued. Or you can make payment at any Scottish Justice of the Peace Court in person. If you are paying by cheque please make it payable to the “Scottish Court Service”. If you are the holder of a non DVLA issued licence this should be presented to a Scottish Justice of the Peace Court with your payment.
DO NOT send your licence and money to the Safety Camera Partnership.
I want to decline the Conditional Offer, what happens next?
Do not pay the Conditional Offer within the 28 day period. Once this has expired the Procurator Fiscal will be in touch to arrange a Court hearing.
What do I do now?
You have to decide if you want to accept the Conditional Offer, this means that you are admitting that you have committed an offence. It should be noted that acceptance of the Conditional Offer is final and no discussion or plea of mitigation can be entered into.
If you decide to decline the Conditional Offer it means that you wish to contest the offence in Court.
Can I attend a driver awareness scheme as an alternative to the Conditional Offer?
No, there is no such scheme available for this offence in Scotland. Presently these courses are only available if an offence has been commited in England.
